Mai 2006 offenzulegen. Auf diesen Antrag hin erkl\u00e4rte sich die Kommission schlie\u00dflich bereit, eine ausf\u00fchrlichere, nicht vertrauliche Fassung dieser Entscheidung erneut zu ver\u00f6ffentlichen.<\/p>\n<p>Die von zwei Adressaten der Entscheidung, Akzo Nobel NV und Evonik Degussa GmbH, gegen die erneute Ver\u00f6ffentlichung erhobenen Einw\u00e4nde wurden vom Gericht der Europ\u00e4ischen Union zur\u00fcckgewiesen. In seinen Urteilen vom 28. Januar 2015 best\u00e4tigte das Gericht, dass die beabsichtigte Neuver\u00f6ffentlichung Informationen offenlegen w\u00fcrde, die geeignet sind, den Nachweis eines Schadens, den Personen erlitten haben, die sich wie CDC durch die in der Entscheidung geahndete Zuwiderhandlung f\u00fcr beschwert halten, sowie den Kausalzusammenhang zwischen dieser Zuwiderhandlung und dem behaupteten Schaden zu erleichtern. CDC war im Verfahren \u00fcber die Klage von Akzo Nobel auf Seiten der Kommission dem Rechtsstreit beigetreten\u00a0<a href=\"https:\/\/curia.europa.eu\/juris\/document\/document.jsf?docid=161841&amp;text=&amp;dir=&amp;doclang=EN&amp;part=1&amp;occ=first&amp;mode=DOC&amp;pageIndex=0&amp;cid=12951487\">(Fall T-345\/12)<\/a>.<\/p>\n<p>W\u00e4hrend das Urteil gegen Akzo Nobel rechtskr\u00e4ftig wurde, wurde gegen das parallele Urteil gegen Evonik Degussa vor dem Europ\u00e4ischen Gerichtshof Berufung eingelegt. Zu diesem Rechtsmittel hat der Generalanwalt am 21. Juli 2016 seine Schlussantr\u00e4ge gestellt (<a href=\"http:\/\/curia.europa.eu\/juris\/document\/document.jsf;jsessionid=51D5347178F949A39635839754508E83?text=&amp;docid=181933&amp;pageIndex=0&amp;doclang=EN&amp;mode=lst&amp;dir=&amp;occ=first&amp;part=1&amp;cid=7058669\" target=\"_blank\" rel=\"noopener\">Fall C-162\/15 P<\/a>). Es gibt klare Richtlinien vor bez\u00fcglich des angeblichen Konflikts zwischen dem Schutz der Rechte von Kronzeugen einerseits und dem Recht der \u00d6ffentlichkeit auf Zugang zu Informationen im Allgemeinen sowie von Personen, die durch das gemeldete wettbewerbswidrige Verhalten m\u00f6glicherweise gesch\u00e4digt wurden, im Besonderen.<\/p>\n<p>Der Europ\u00e4ische Gerichtshof hat in seinem Urteil vom 14. M\u00e4rz 2017 das Urteil zu Evonik Degussa aus formalen Gr\u00fcnden aufgehoben (<a href=\"http:\/\/curia.europa.eu\/juris\/document\/document.jsf;jsessionid=51D5347178F949A39635839754508E83?text=&amp;docid=188851&amp;pageIndex=0&amp;doclang=EN&amp;mode=lst&amp;dir=&amp;occ=first&amp;part=1&amp;cid=7058669\" target=\"_blank\" rel=\"noopener\">Fall C-162\/15 P<\/a>). Davon abgesehen best\u00e4tigt der Gerichtshof jedoch im Wesentlichen das Urteil des Gerichts. Er weist insbesondere darauf hin, dass eine Vertragsverletzungsentscheidung der Kommission es erm\u00f6glicht, Kartellopfer bei ihren Schadensersatzklagen gegen die Rechtsverletzer zu unterst\u00fctzen. Au\u00dferdem pr\u00e4zisiert das Gericht in allgemeiner Form die Voraussetzungen f\u00fcr die Ver\u00f6ffentlichung von Informationen aus Unterlagen, die ein Kartellmitglied der Kommission zur Unterst\u00fctzung einer Erkl\u00e4rung zur Erlangung der Kronzeugenregelung vorgelegt hat.<b><\/b><\/p>\n<p>Dies wird erhebliche Auswirkungen auf zuk\u00fcnftige F\u00e4lle haben, die insbesondere den Zugang zu Informationen \u00fcber Kartellverst\u00f6\u00dfe erfordern.<\/p>","protected":false},"excerpt":{"rendered":"<p>Further landmark decisions of the European courts stem from a request by CDC to the European Commission to disclose confidential parts of its Hydrogen Peroxide cartel decision of 3 May 2006.
