Mai 2006 in der Sache COMP\/38.620 zum europaweiten Wasserstoffperoxid-Kartell beantragte CDC bei der Europ\u00e4ischen Kommission auf der Grundlage der Transparenzverordnung vollst\u00e4ndigen Zugang zum Inhaltsverzeichnis der Verwaltungsakte. Nach der Ablehnung des Antrags erhob CDC am 6. Oktober 2008 beim Gericht der Europ\u00e4ischen Union eine Nichtigkeitsklage gegen die Kommission.<\/p>\n<p>Das Gericht erlie\u00df eine f\u00fcr CDC g\u00fcnstige&nbsp;<a href=\"http:\/\/curia.europa.eu\/juris\/document\/document.jsf?text=&amp;docid=116703&amp;pageIndex=0&amp;doclang=EN&amp;mode=lst&amp;dir=&amp;occ=first&amp;part=1&amp;cid=10027\" target=\"_blank\" rel=\"noopener\">Entscheidung<\/a>&nbsp;am 15. Dezember 2011. Es folgte insbesondere der Ansicht von CDC, dass das Interesse eines Kartellmitglieds an der Vermeidung von Schadensersatzklagen gegen sich selbst kein Interesse darstellt, das die Nichtoffenlegung des angeforderten Dokuments nach der Transparenzverordnung rechtfertigen k\u00f6nnte.
